Terms of Service

These Terms of Service govern the use of services provided by Brandit 4U SA. By engaging our services, you agree to these terms.

1. Services

Brandit 4U SA provides digital and technology services, including:

• Website Design & Development

• E-Commerce Development

• SEO & Local SEO

• Google Business Profile Setup & Optimization

• Google Ads & Meta Ads Management

• Social Media Management

• Graphic Design & Branding

• Web Hosting and related digital services

The specific services included in a project will be outlined in the applicable quotation, proposal or service agreement.

2. Project Scope

Work will be completed according to the agreed scope of work.

Requests outside the agreed scope, additional features, major design changes or additional revisions may result in additional charges.

Any additional costs will be communicated to the client before the additional work is undertaken.

3. Client Responsibilities

The client is responsible for providing accurate information, content, images, logos, documents and other materials required to complete the project.

The client is also responsible for reviewing and approving content and designs before publication or launch.

Clients must ensure that materials supplied to Brandit 4U SA do not infringe the rights of any third party.

4. Payment Terms

Payment terms will be specified in the applicable quotation or invoice.

A deposit or upfront payment may be required before work begins.

Monthly services are payable in advance unless otherwise agreed in writing.

Brandit 4U SA reserves the right to pause or suspend services where payment is overdue.

5. Website Ownership & Intellectual Property

Unless otherwise agreed in writing, ownership of the completed website and applicable project files will transfer to the client once all outstanding payments relating to the project have been paid in full.

Brandit 4U SA retains ownership of its pre-existing tools, systems, templates, processes, methods and other intellectual property used to deliver services.

Third-party software, plugins, themes, stock images, fonts and other licensed materials remain subject to their respective licence terms.

6. Hosting & Domains

Where Brandit 4U SA provides hosting or domain-related services, these services are subject to the terms and policies of the relevant service providers.

Clients remain responsible for applicable renewal fees unless otherwise agreed.

Brandit 4U SA is not responsible for interruptions caused by third-party hosting providers, domain registrars or other external services.

7. SEO & Digital Marketing

Brandit 4U SA applies professional industry practices to SEO, Google Business Profile, Google Ads, Meta Ads and other digital marketing services.

However, we do not guarantee specific search rankings, advertising results, leads, sales, traffic or revenue.

Marketing performance may be affected by factors outside our control, including competition, platform changes, market conditions and customer behaviour.

8. Suspension & Termination

Brandit 4U SA may suspend services where:

• Payments remain outstanding

• The client breaches these Terms

• Services are used unlawfully

• The client provides misleading or unlawful information

Either party may terminate an ongoing service arrangement in accordance with the applicable agreement or written notice.

Outstanding amounts remain payable following termination.

9. Limitation of Liability

To the fullest extent permitted by South African law, Brandit 4U SA will not be liable for indirect or consequential losses, loss of profits, loss of business opportunities, loss of data or business interruption arising from the use of our services.

Our total liability relating to a specific service will, where legally permitted, be limited to the amount paid by the client for that service.

10. Confidentiality

Both parties agree to keep confidential information received during the course of a project or service arrangement confidential, except where disclosure is required by law or reasonably necessary to provide the agreed services.

11. Privacy

Personal information collected through our services is handled in accordance with our Privacy Policy and applicable South African data protection laws.

12. Changes to These Terms

Brandit 4U SA reserves the right to update these Terms of Service from time to time.

The latest version will be published on our website and will apply from the stated effective date.

13. Governing Law

These Terms of Service are governed by the laws of the Republic of South Africa.

Any disputes will, where appropriate, be subject to the jurisdiction of the courts of South Africa.
